Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at mobileservicesync.com (the "Site") and any related services offered by Mobile Service Sync ("we," "us," or "our"). By using the Site, joining the waitlist, or opting in to our SMS messaging program, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Mobile Service Sync is a forthcoming software product. By submitting your information to the waitlist you are not entering into a contract for services and you owe us no payment. Joining the waitlist does not guarantee access to the product, pricing, or any specific feature. We may close the waitlist or revise the program at any time.

This section describes the terms of our application-to-person SMS program. By providing your mobile phone number and checking the SMS consent box on the waitlist form, you agree to the following:

• Program description. You will receive recurring text messages from Mobile Service Sync regarding your waitlist status, product launch updates, early-access offers, and related transactional or promotional messages.
• Message frequency. Varies. Most subscribers will receive fewer than four messages per month.
• Message and data rates. May apply. You are responsible for any charges from your wireless carrier.
• Carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for any technical issues that prevent message delivery.
• Opt out. You can opt out of the program at any time by replying STOP to any message we send. After opting out, you will receive a confirmation message and no further marketing texts. To rejoin, sign up again on the Site.
• Help. Reply HELP to any message for support, or email support@mobileservicesync.com.
• Eligibility. You must be the account holder or authorized user of the mobile phone number you submit. You must be at least 18 years old, or have your parent or guardian's consent if you are between 13 and 18.
• Not a condition of purchase. Your consent to receive SMS messages is not a condition of any purchase or your use of the Services.

You agree not to:

• Submit information about anyone other than yourself, or use a phone number or email address you are not authorized to use.
• Use the Site or Services to transmit unlawful, harmful, fraudulent, or otherwise objectionable content.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site, our servers, or other systems connected to the Services.
• Reverse engineer, decompile, or attempt to extract the source code of any software underlying the Services, except to the extent expressly permitted by applicable law.

All content on the Site — including text, graphics, logos, marks, and software — is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the Site for its intended purpose. No other rights are granted.

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILE SERVICE SYNC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Iowa, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Polk County, Iowa, and you consent to personal jurisdiction in those courts.
