Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at mobileservicesync.com and any related marketing pages, contact forms, demo request flows, and SMS messaging program operated by Oil To Go, LLC dba Mobile Service Sync ("Mobile Service Sync," "we," "us," or "our") (collectively, the "Site"). By using the Site or opting in to our SMS messaging program, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Use of the Mobile Service Sync software-as-a-service product (the "Service"), including the CRM application, mobile apps, customer-facing portals, and APIs, is governed by our End User License Agreement, which is the controlling agreement for paying and trial customers. To the extent of any conflict between these Terms and the EULA with respect to the Service, the EULA controls.

The Site provides information about the Service, lets you contact us, request a demo, and create or sign in to an account. Visiting the Site does not create an account, a subscription, or a contract for services. To use the Service, you must create an account and accept the EULA.

This section describes the terms of our application-to-person SMS program for marketing, demo follow-up, and product news. Transactional account messages sent to active customers (such as billing or security notifications) are governed by the EULA. By providing your mobile phone number and checking the SMS consent box on a Mobile Service Sync form, you agree to the following:

• Program description. You will receive recurring text messages from Mobile Service Sync regarding product updates, new features, demo follow-up, special offers, event invitations, and related transactional or promotional messages.
• Message frequency. Varies. Most subscribers will receive fewer than four messages per month.
• Message and data rates. May apply. You are responsible for any charges from your wireless carrier.
• Carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for any technical issues that prevent message delivery.
• Opt out. You can opt out of the program at any time by replying STOP to any message we send. After opting out, you will receive a confirmation message and no further marketing texts. To rejoin, sign up again on the Site.
• Help. Reply HELP to any message for support, or email support@mobileservicesync.com.
• Eligibility. You must be the account holder or authorized user of the mobile phone number you submit. You must be at least 18 years old, or have your parent or guardian's consent if you are between 13 and 18.
• Not a condition of purchase. Your consent to receive SMS messages is not a condition of any purchase or your use of the Service.

If you create an account on the Site, you are responsible for keeping your credentials confidential and for all activity under your account. You must provide accurate information, keep it up to date, and notify us at security@mobileservicesync.com of any suspected unauthorized access. We may suspend or terminate accounts that are inactive, that violate these Terms or the EULA, or that we reasonably believe were obtained by fraud.

You agree not to:

• Submit information about anyone other than yourself, or use a phone number or email address you are not authorized to use.
• Use the Site to transmit unlawful, harmful, fraudulent, or otherwise objectionable content.
• Attempt to interfere with, disrupt, or gain unauthorized access to the Site, our servers, or other systems connected to the Service.
• Scrape, crawl, or harvest content or data from the Site by automated means, except as expressly permitted by our robots.txt and applicable law.
• Reverse engineer, decompile, or attempt to extract the source code of any software underlying the Site or the Service, except to the extent expressly permitted by applicable law.

All content on the Site, including text, graphics, logos, marks, screenshots, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-exclusive license to use the Site for its intended purpose. No other rights are granted. "Mobile Service Sync" and the Mobile Service Sync logo are trademarks of Oil To Go, LLC and may not be used without our prior written permission.

The Site may link to third-party websites or services that we do not control. We are not responsible for the content, policies, or practices of any third-party site, and your use of any third-party site is at your own risk and subject to that site's terms and privacy policy.

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. INFORMATION ON THE SITE ABOUT THE SERVICE IS FOR GENERAL DESCRIPTION ONLY; ACTUAL FUNCTIONALITY, AVAILABILITY, AND PRICING ARE GOVERNED BY THE EULA AND YOUR ORDER FORM.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOBILE SERVICE SYNC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). LIABILITY ARISING OUT OF YOUR USE OF THE SERVICE IS GOVERNED BY THE EULA.

We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Iowa, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms will be resolved exclusively in the state or federal courts located in Linn County, Iowa, and you consent to personal jurisdiction in those courts.
